01Definitions
"Company," "we," "us," and "our" refer to Biz Boosters LLC, doing business as Hustle Smarter Marketing. "Client," "you," and "your" refer to the individual or business entity using our website or engaging our services. "Services" refers to web design, digital marketing, SEO, print design, digital products, mentorship programs, and any other offerings we provide.
02Eligibility
You must be at least 18 years old and have the legal authority to enter into a binding contract on behalf of yourself or the business you represent. By using our services, you represent and warrant that you meet these requirements.
03Services Offered
Hustle Smarter Marketing provides a range of services to home service professionals and small businesses, including but not limited to:
- Custom website design and development (WordPress, Elementor, WooCommerce)
- Search engine optimization (SEO) and local SEO
- Google Business Profile optimization and management
- Print design (door hangers, yard signs, vehicle wraps, business cards)
- Digital products (templates, guides, spreadsheets, contracts)
- Mentorship, coaching, and Shadow Day programs
- Marketing consultation and strategy
Specific deliverables, scope, and timelines for any engagement will be outlined in a separate written agreement, statement of work, or proposal.
04Service Agreements
For most services, a separate service agreement, contract, or proposal will be provided that outlines specific terms including scope of work, deliverables, timelines, revisions, and pricing. In the event of any conflict between these Terms and a signed service agreement, the signed service agreement shall control with respect to that engagement.
05Payment Terms
Invoicing & Payment
Unless otherwise specified in a written agreement, payment is due as outlined in your invoice or contract. We accept payment via the methods made available at checkout or invoicing. A deposit may be required before work begins.
Late Payments
Payments not received by the due date may be subject to late fees, suspension of services, or both. Repeated non-payment may result in termination of the engagement and forfeiture of any deposits.
Recurring Services
Services billed on a recurring basis (such as hosting, monthly SEO retainers, or subscription products) will continue to renew until canceled in accordance with the cancellation procedures specified in your agreement.
06Refund Policy
Custom Services
Custom design and development work is generally non-refundable once work has begun. If a project is canceled mid-engagement, you remain responsible for payment for all work completed up to the cancellation date.
Digital Products
Digital products, including templates, guides, contracts, and spreadsheets, are non-refundable once delivered or accessed due to their digital nature.
Mentorship & Coaching
Mentorship programs, coaching sessions, and Shadow Day services follow a no-refund policy as detailed in the individual program agreement. Early termination fees may apply.
Recurring Services
Recurring service fees already billed are non-refundable. Cancellation will stop future billing as outlined in your agreement.
07Digital Products
When you purchase a digital product, you receive a non-exclusive, non-transferable license to use the product for your own business purposes. You may not:
- Resell, redistribute, or share the product with third parties
- Claim the product as your own original work
- Remove copyright or attribution notices
- Use the product to create competing products for sale
Customizing the product for your own internal business use is permitted and encouraged.
08Mentorship & Coaching
Our mentorship, coaching, and Shadow Day programs are educational in nature. Specific program terms, including session structure, recording consent, and confidentiality, are outlined in the individual program agreement signed via our CRM.
By participating in these programs, you acknowledge that:
- Results vary based on individual effort, market conditions, and other factors outside our control
- We make no guarantees regarding business outcomes, revenue, or specific results
- Program sessions may be recorded for educational purposes with your consent
- Information shared in mentorship is for your business use and is not to be redistributed
09Client Responsibilities
To ensure a successful engagement, you agree to:
- Provide accurate, complete, and timely information needed for the project
- Supply content, assets, login credentials, and approvals in a reasonable timeframe
- Respond to communications and review deliverables within agreed-upon turnaround times
- Make payments on time according to the agreed schedule
- Ensure you have the rights to use any content, images, or materials you provide to us
- Maintain backups of your own data and content
Delays caused by your failure to meet these responsibilities may result in project delays for which we are not responsible.
10Intellectual Property
Our Materials
All content on our website, including text, graphics, logos, images, code, and digital products, is the property of Hustle Smarter Marketing or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or distribute our materials without prior written permission.
Client Deliverables
Upon full payment of all fees, you receive ownership rights to the final deliverables produced specifically for you, except for: (a) third-party assets, plugins, themes, fonts, or stock content, which remain subject to their respective licenses; and (b) our proprietary tools, processes, code libraries, and underlying methodologies, which remain our property.
Portfolio Use
We reserve the right to display work produced for clients in our portfolio, case studies, and marketing materials unless you specifically request otherwise in writing.
11Third-Party Services
Our services often integrate with or rely on third-party platforms (such as WordPress, Elementor, Cloudways, WooCommerce, Google, and others). We are not responsible for the availability, performance, or policies of these third-party services. Your use of third-party services is governed by their own terms and policies.
12Disclaimers
Our services are provided on an "as is" and "as available" basis. While we work hard to deliver excellent results, we make no warranties or guarantees regarding:
- Specific search engine rankings or SEO outcomes
- Specific business or revenue results
- Uninterrupted or error-free operation of websites or services
- The performance of third-party platforms or tools
Any business or marketing advice provided is for informational purposes and does not constitute legal, financial, or professional advice. You should consult appropriate professionals before making business decisions.
13Limitation of Liability
To the fullest extent permitted by law, Hustle Smarter Marketing, its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or website. Our total liability for any claim arising from our services shall not exceed the amount you paid us for the specific service giving rise to the claim during the three (3) months preceding the claim.
14Indemnification
You agree to indemnify, defend, and hold harmless Hustle Smarter Marketing and its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of our services; (b) content or materials you provide to us; (c) your violation of these Terms; or (d) your violation of any third-party rights or applicable laws.
15Termination
Either party may terminate an engagement in accordance with the terms of the applicable service agreement. We reserve the right to suspend or terminate services immediately if you breach these Terms, fail to make payment, or engage in conduct that we determine to be harmful to our business or other clients.
Upon termination, you remain responsible for any unpaid fees for work completed, and provisions that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
16Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in Virginia, and you consent to the jurisdiction of those courts.
17Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
